1. Acceptance of Terms

By accessing or using Sportacus ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Account Registration

You must be at least 13 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current information during registration.

3. User-Generated Content

You retain ownership of content you post on Sportacus. By posting, you grant Sportacus a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content within the Platform and for promotional purposes.

You are solely responsible for the content you post. Content must comply with our Community Guidelines.

4. Fact or Cap

The "Fact or Cap" voting mechanic is a community engagement feature. Votes represent community opinion and do not constitute verified facts. Sportacus is not responsible for the accuracy of claims or votes.

5. Community Guidelines

Users must not:

  • Post content that is illegal, threatening, abusive, harassing, or defamatory.
  • Impersonate other users, athletes, or public figures.
  • Share personal contact information in coach-to-athlete messages.
  • Use the Platform for gambling, betting, or illegal activity.
  • Spam, manipulate votes, or create fake accounts.
  • Post content unrelated to sports.

6. Intellectual Property

"Sportacus," "Fact or Cap," and "RAEDA" are trademarks of Sportacus. The Platform's design, code, and branding are protected by intellectual property laws. You may not copy, modify, or redistribute any part of the Platform without written permission.

7. DMCA Policy

If you believe your copyrighted work has been infringed on Sportacus, please send a DMCA takedown notice to support@sportacus.app with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that the information is accurate.

8. RAEDA Pro Subscription

  • Pricing: RAEDA Pro costs $29 per month, billed monthly.
  • Free trial: New subscribers may be eligible for a free trial period.
  • Cancellation: You may cancel at any time. Access continues through the end of the billing period.
  • Refunds: Refunds are not provided for partial billing periods. If you experience a billing issue, contact support.
  • Changes: We may modify subscription pricing with 30 days' notice.

9. Coach Verification & Athlete Safety

Coaches must complete verification before contacting athletes. Verification methods include institutional email, LinkedIn profile review, and credential upload. Sportacus reviews verification requests but does not guarantee the accuracy of coach credentials.

For athletes under 18, parent/guardian consent is required before coach contact. All coach messages are logged and monitored. Personal contact information is filtered from messages for safety.

10. Prohibited Content

The following content is prohibited and will be removed:

  • Hate speech, discrimination, or content targeting protected groups.
  • Explicit sexual content or nudity.
  • Violence or threats of violence.
  • Private personal information (doxxing).
  • Spam, scams, or misleading content.
  • Content unrelated to sports.

11. Termination

Sportacus may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app settings.

12. Limitation of Liability

Sportacus is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Sportacus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.
